NEW DELHI: The Supreme Court on Tuesday reverted to the Jharkhand High Court to first decide the maintainability of a PIL seeking investigation by the CBI and the Enforcement Directorate against a mining lease granted by Chief Miniter Hemant Soren to himelf.
“We direct the Jharkhand High Court to first consider the maintainability of a PIL pending before the High Court,” said a two-judge vacation Bench of Dr D Y Chandrachud, andJustice Bela M Trivedi on a petition filed by the chief minister.
“We are of the considered view that the High Court would first deal with the preliminary objections on the maintainability of the writ petition and then proceed further in accordance with law,” the bench said, noting that the HC is already seized of the matter.
The mining lease was allegedly granted to Chief Minister Soren and some shell companies operated by his family members and associates.
