It asserts that the UCC violates the constitutional freedom to practice the religion of choice that allows the religious communities to follow their respective personal laws as Article 25 gives every religious group the right to manage own affairs.
The CLMC asserted that the UCC would violate the freedom of religion of the minorities and it is not required as neither it provides any solution to the problems as the current system of personal laws has been refineed through time is working very well whilee the UCC would create a confusion among the people.
In a plural-national, multi-religious and diverse nation like India, the UCC would interfere with the freedom of individuals to practice their religious beliefs as th personal laws have historically governed the matters such as marriage, divorce and inheritance and as such the UCC is a threat to the communal harmony and an attempt of the government’s interference in personal freedom.
Asserting that the UCC can not be forcefully imposed on the people in violation of Article 25, that guarantees freedom of conscience and free profession, practice and propagation of religion, the organisation told Law Commission chairman Justice Ritu Raj Awasthi that our great leaders rejected UCC in the constituent assembly debate in 1948 and which continue to be relevent in the present time.
It quoted Maulana Abdul Kalam Azad, Urdu poet Maulana Hasrat Mohani, who gave the slogan of Inquilab Zindabd, Frank Anthony, Acharya J B Kripalani, socialist leader K T Shah and Begum Aizaz Rasul who had opposed the UCC.
