NEW DELHI/ JOB QUOTA TO LOCALS IN PRIVATE SECTOR: WHAT ABOUT AP & JHARKHAND, ASKS SC

The Supreme Court on Friday proposed to consider the job reservation to locals in the private sector in Andhra Pradesh and Jharkhand along with one granted in Haryana.

A Bench of Justices L Nageswara Rao and Bhushan R Gavai raised the issue while hearing an appeal by the Haryana government challenging an interim stay granted by the Punjab and Haryana Court on its 2020 law providing 75% quota in private sector to the residents of the state.

Asking Solicitor General Tushar Mehta, appearing for Haryana Government, to gather the details on such laws under challenge in various High Courts, the Bench posted the matter for hearing on Monday. It told Mehta: ““If the matters are pending before other high courts, we can hear the larger issue after calling for the papers from high courts, you can inform us.”

At the outset, Mehta submitted that a statute has been stayed by an unreasoned order, after a hearing for only 90 seconds.
He said only a handful of people are opposed to the Act.

Senior advocate Dushyant Dave, appearing for one of the parties, said that this issue requires consideration by the apex court. Senior advocate Mukul Rohatgi said that he would ponder over the issue after consulting his clients.

On February 3, the Punjab and Haryana High Court granted an interim stay on the Haryana law on the pleas filed by the industry associations of Fridabad and Gurgaon.

The Act provides 75 per cent reservation in the private sector to job seekers from the state and came into force from January 15 after being notified in November last year. It applies to jobs offering a maximum gross monthly salary or wages of Rs 30,000.

It is applicable to the private sector companies, societies, trusts, partnership firms, limited liability partnership firms and any person who employ ten or more persons on salaries, wages or other remuneration for manufacturing or rendering any service in Haryana.

Haryana Governor Bandaru Dattatreya had in March 2021 given assent to the Haryana State Employment of Local Candidates Bill, 2020.
