NEW DELHI: The Supreme Court has rapped a senior Enforcement Directorate officer for filing an appeal seeking cancellation of the bail granted to an accused suffering from cancer, for “wasting stationery, legal fees and the court’s time.”
The person, an employee of a private bank, was arrested in connection with the embezzlement of Rs 24 crore.,
A Bench of Justices M R Shah and M M Sundresh quashed the petition with an exemplary cost and imposed a cost of Rs 1 lakh to be borne personally by the officer concerned, who had granted permission to ED to file the special leave petition. The fine will be recovered from the officer’s salary, the court said.
“The cost to be so recovered by the department shall be deposited with the Court registry within four weeks,” the Court said in a recent order, ruling that half of it will be transferred to the National Legal Services Authority, New Delhi and another half to Mediation and Conciliation Project Committee of the Supreme Court.
