SC SENDS SURJEWALA TO HC ON LINKING AADHAAR, VOTER ID

NEW DELHI: The Supreme Court on Monday directed Congress leader Randeep Singh Surjewala to approach the Delhi High Court on his petition challenging the Election Laws (Amendment) Bill passed in December 2021 for linking Aadhaar with the Voter IDs.

Giving liberty to him to move the High Court, a Bench of Justices D Y Chandrachud and A S Bopanna said: “Since the PIL petitioner challenges the validity of Section 4 and 5 of the Election Law Amendment Act an efficacious alternate remedy is before the High Court.”

In his petition, Surjewala had challenged the linkage as completely “irrational” and “infringement upon the fundamental right of privacy of citizens and is unconstitutional and ultra vires.”

His contention is that the linkage imposes a limitation on the voters, who will have to establish their identity before the electoral registration officer by furnishing their respective Aadhaar details and as such their personal and private daata available to the statutory authority.
