NEW DELHI: The Supreme Court has listed the case of the advance stage abortion on August 2, in which it allowed an unmarried woman to go for it after approval of a medical board of the All India Institute of Medical Sciences (AIIMS), New Delhi without danger to her life and after her written consent once again.
In a detailed 12-page ruling on Thursday, the Bench of Justices Dr Dhananjaya Y Chandrachud, Surya Kant and A S Bopanna noted that the woman is a permanent resident of Manipur and she is currently residing in Delhi.
She learnt about her pregnancy in June from a consensual relationship and sought to terminate it since she would be unable to raise and nurture the child and her partner deserted her at the last stage in June causing immense mental agony, trauma and physical suffering.
The judgment discusses at length the Medical Termination of Pregnancy Act, 1971, and the Medical Termination of Pregnancy Rules, 2003. The Bench sought assistance of additional solicitor general Ms Aishwarya Bhati in the interpretation of the law and the rules.
The woman had come to the top court after a division bench of Delhi High Court rejected early this month her prayer for termination of the pregnancy at an advance stage.
