TELANGANA ASKED TO PAY 2.5 LAKH COST IN 2020 VERDICT

NEW DELHI: The Supreme Court on Tuesday gave two weeks to the Telangana government to deposit Rs 2.5 lakh imposed as a cost on April 22, 2020, after a 5-judge Constitution Bench quashed a 2000 order of the erstwhile pre-bifurcated Andhra Pradesh Government.

The quashed order provided 100% reservation to the scheduled tribes as teachers in schools located in predominantly tribal area. The top court had imposeda cost of Rs 5 lakh to be divided equally between Andhra Pradesh and Telangana. The Andhra Pradesh government has already deposited its share with the top court’s registry.

A vacation bench comprising Justice M.R.Shah and Justice Aniruddha Bose said that failure to do so will be viewed  “very seriously” and indicated that it may haul up the State Chief Secretary for not complying with the order passed more than two years ago.

The five-judge constitution bench headed by Justice Arun Mishra (since retired) and comprising Justice Indira Banerjee, Justice Vineet Saran (since retired), Justice M.R.Shah and Justice Aniruddha Bose had said that 100% reservation for scheduled tribes  in the teachers posts in the schools located a predominantly tribal areas was not permissible and no reservation could exceed the limit of 50% as fixed by the top court in Indra Sawhney case on November 16, 1992.
