KASHMIRI FATHER GIVES UP PLEA TO EXHUME SON’S BODY

NEW DELHI: Mohd Latief Magrey of Kashmir on Monday gave up the demand for exhuming the body of his son killed in a police encounter in Hyderpora in November 2021.

He had come to the Supreme Court against a division bench of the J&K High Court staying a permission granted by a single judge bench on May 27.

His counsel told the Court that he no longer wants the body of his son, which was his first prayer, but the family be allowed to perform the last rites as per his second prayer.

A Bench of Justices Surya Kant and J B Pardiwala told him that since he had withdrawn his first prayer, let the J&K High Court consider his second prayer. He wanted an order to the High Court, but the bench declined saying it has confidence in justice by the High Court.

Since his son was dubbed a terrorist, the police do not hand over the body of such a person but carry out the burial itself.
