MOGA MAN BAIL CANCELLED FOR POSSESSING OPIUM

NEW DELHI: The Supreme Court has cancelled the bail it had granted to one Sukhdev Singh of Moga in Punjab in October 2016 and told to surrender before the trial court to serve the remainder of sentence for allegedly possessing 4kg of opium.

A Bench of Chief Justice N V Ramana and Justices A S Bopanna and Hima Kohli dismissed his appeal on February 22 and upheld his sentence by the trial court as also the High Court.

The dispute was whether the siezed sample of powder checked by the chemical examiner was opium or not since the petitioner argued that opium is a sticky material and cannot be in a powder form. The examiner certified that the material was found to contain morphine and meconic acid.

The Court held that the Narcotic Drugs and Psychotropic Substances (NDPS) Act does not prescribe physical analysis during the testing as adverted by the sessions court and confirmed by the High Court.
